Terms & Conditions
§ 1 Scope
The following terms and conditions, in the version valid at the time of the order, apply to all orders placed via our online shop at moodyfruits.com. Our offer is directed exclusively at consumers.
§ 2 Contracting party and conclusion of contract
The purchase contract is concluded with:

The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to order. By clicking the order button, you place a binding order for the goods in your shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation by email or by delivering the goods.
§ 3 Prices and shipping
All stated prices are final prices. For delivery within Germany, shipping costs are already included – shipping is free for you. For delivery to other European Union countries, additional shipping costs apply, which are shown to you during the order process before you place your order. As a small business within the meaning of § 19 of the German VAT Act (UStG), we do not charge VAT and therefore do not show it.
§ 4 Delivery
Delivery is by DHL to Germany and to other European Union countries. Within Germany, delivery usually takes 3–5 business days from conclusion of the contract; delivery to other EU countries may take longer. Delivery to countries outside the European Union is currently not offered.
§ 5 Payment
Payment is processed via our payment service provider Stripe (Stripe Payments Europe, Ltd.). Depending on availability, payment methods include credit/debit card, Apple Pay and Google Pay. The purchase price is due upon completion of the order.
§ 6 Retention of title
The goods remain our property until full payment has been received.
§ 7 Right of withdrawal
As a consumer, you have a statutory right of withdrawal. You can find the details in our cancellation policy.
§ 8 Warranty
The statutory rights regarding defects apply.
§ 9 Dispute resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
The law of the Federal Republic of Germany applies. Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
